A mowing crew worker was seriously injured in a motor vehicle collision near Bedford, Kentucky, according to a recent news report. The worker was riding in the bed of a pick-up truck on U.S. 42 when another vehicle ran into the back of the truck. The impact caused the worker to fall out of the truck and strike his head. The worker was airlifted to a nearby hospital.
Kentucky Transportation Accidents
Workplace accidents can occur under a wide variety of circumstances. However, figures released by the Bureau of Labor Statistics tell us that transportation accidents kill or seriously injure more workers in the United States than any other type of workplace accident.
In fact, 1,150 workers were fatally injured in transportation workplace accidents last year, accounting for 26 percent of all fatal work-related injuries that year. Many of those killed operated vehicles on a regular basis in the normal course of their employment. A significant percentage of those injured were driving to or from job sites.
A worker who is injured in a motor vehicle collision while riding in a vehicle between job sites may be entitled to workers’ compensation benefits.
While each workplace accident presents a unique set of facts and circumstances, a central issue when determining whether a worker is entitled to workers’ compensation benefits is whether the worker was within the “scope of employment” at the time of the injury.
If a worker was driving to work in the morning, for example, and was involved in a motor vehicle collision, any injuries would likely not be compensable because the worker had not yet reported to work for the day.
On the other hand, if a worker is regularly required to commute between job sites and is involved in a collision while on the way from one site to another as a result of orders issued by the employer, the injuries would likely qualify for workers’ compensation.
